PT Kejora Gemilang Internusa "PLANET BROADBAND"
& "Citi-link" INTERNET TERMS & CONDITIONS
PT. Kejora
Gemilang Internusa provides its Prepaid Broadband Access Service called Planet
Broadband and Citi-Link internet as they may exist from time to time. The concept
is simple: establish a basic acceptable level of Internet Access Service based
on Kejora BPL/PLAN (Broadband Powerline/Powerline Access Network) and Kejora
Citi-Link Infrastructure and
offer it to Subscriber with attractive price performance value. The following
Terms and Conditions apply to all persons and/or business entities
(´Subscribers´) using Kejora Prepaid Broadband Service (´Service´).
The Service is only available within the range of certain locations that make up
Kejora Citi-Link and Planet
Broadband BPL/PLA Network, which may change from time to time.
Any coverage maps are based on the coverage of Kejora Point-of-Presence but not
a guarantee of service coverage, which may vary from place to place.
The quality and availability of the Service may sometimes be affected by factors
outside Kejora control - such as features or functionality of Subscriber
Device(s), the number of people trying to use the network at the same time, the
need for routine maintenance, virus attacks, peak demand, general power outage
at the location where Subscriber is accessing the Service and faults in global
telecommunication networks to which the Network is connected.
By registering to, or continued use of Kejora Prepaid Broadband Service
(´Service´), or by using Kejora provided integrated Service and/or Equipment,
Subscriber understands, accepts and agrees to use the Service in compliance with
this Terms and Conditions which follow the common Internet usage best practice
and shall have the same force and effect as if Subscriber had actually signed
the Agreement.
If Subscriber chooses to access the Service, Subscriber does so at own risk and
Subscriber is responsible for compliance with local laws, if and to the extent
local laws are applicable. Kejora reserves the right to change the terms,
conditions, and notices, including but not limited to the charges associated
with the use of Kejora Prepaid Broadband Service (´Service´).
1. Acceptable Use
-
Kejora
grants the Subscriber, a non-exclusive, non-transferable, limited license to
the Service, which is provided "as is"; "with all faults" and "as available"
basis.

All
bandwidth delivered to Kejora Prepaid Broadband Service's Subscriber is
shared and in some cases burstable, therefore, Kejora is not in the position to offer
Service Level Guarantee which indicates that the Service will be available
to all Subscribers with certain level of quality at all times.

The
Service shall be activated after Subscriber has signed the Application Form,
purchase and pay the Kejora Activation Fee.

Subscriber agrees not to resell any aspect of the Service, whether for
profit or otherwise, shares the assigned IP address (if provided) or
Internet connection with any other entity to use the Service outside of the
subscribers own premises.

Sharing
the Service with another entity breaches this Terms and Conditions of Use
and may constitute fraud or theft, for which Kejora reserve all rights and
remedies.

Kejora
will in its best endeavours, keep Internet access available continuously.
However, Kejora makes no guarantees that access will be available at all
times and shall not be held liable for any losses whatsoever that may be
incurred by the Subscriber as a result of the Subscriber inability to gain
access to the Internet.

The
Network and the Services may from time to time require upgrading,
modification, maintenance or other works. These may result in some or all of
the Services becoming temporarily unavailable. In such cases, Kejora will do
everything to keep the period of non-availability to a minimum; however,
some interruption may be inevitable.

Kejora
also assumes no responsibility and shall not be liable for any damages to or
viruses that may infect Subscriber computer equipment or other property of
the Subscriber access to, use of, or browsing the Internet, or downloading
of any materials, data, text, images, video or audio via the Service.

Any
arrangements made between Subscriber and any third party through the Service
is at Subscriber sole risk and responsibility and Kejora expressly disclaims
any liability for third party information or opinions or any linked website
that arises under criminal or civil laws relating to defamation,
intellectual property infringement, privacy, obscenity, or any other area of
law.
2. Subscriber Obligations

Subscriber is responsible for providing equipment capable of receiving and
transmitting electronic data through a standard port (RJ-45) which
technically and operationally compatible with the Service and Kejora will
not provide technical support for equipment, network or software that is not
part of the Service.

If the
Service cannot be made to work at Subscriber location because of any cause,
Kejora has no other liability if certain condition proves impossible to
provide the Service for and Subscriber is entitled for total refund of any
payment had been made to Kejora.

Subscriber will allow Kejora employees or contractors to access Subscriber
premises, install and configure the Service and at a time that is convenient
for Subscriber and Subscriber is also entitled to technical support (24 X 7)
for the Service provided by Kejora via phone or email only.
3. Subscription Termination
-
Kejora
Prepaid Broadband Service is a prepaid service. Customer is required to
purchase Top Up Voucher or pay by TT or cash and select the Service Plan thru Kejora Prepaid Web
Self Care Website in order to use the Service.

Subscriber is free to restore the subscription throughout this notice period
but Kejora reserves the right to charge a reconnect fee for any discontinued
Service that is subsequently reconnected.

Subscriber may terminate the subscription at any time upon official notice
to the Kejora Customer Care. After written notice of termination has been
received, the termination of the Service will be effective at the end of the
current Service Plan period.

Kejora
may suspend or cancel a delinquent Subscriber at any time and for any reason
including, without limitation, any breach of this Terms and Conditions of
Use.

Subscriber will return all of the loaned equipment to Kejora (if provided)
and will allow Kejora employees or contractors to access Subscriber premises
to remove the Equipment and Kejora agrees to arrange a time that is
convenient for Subscriber. Not returning the equipment in good condition is
considered a default and Subscriber must pay Kejora the full retail cost of
the repair or replacement.

In the case
of service having a minimum contract period the subscriber will be
charged an amount equivalent to 50% of the remainder of the contractual
period upon subscription termination
4. Payment Obligations
-
Kejora
Prepaid Service Plan including its Value Added Services fee is posted on the
Kejora's website. Kejora may change or modify or add to the fees it charges
at any time. Such changes, modification or additions will be effective upon
Subscriber acceptance of the new Service Plan. Subscriber should review the
Kejora Website periodically to be aware of any changes to Service Plan�s
subscription fee.

Subscriber must provide Kejora with accurate and complete billing
information, including legal name/company, administrative contact, billing
address, telephone number and credit card information (if required). Any
changes to this information must be advised to Kejora within the current
subscription month.
-
If
current Service Plan expired, the Service is automatically suspended by
Kejora Billing System at the end of expiration date and to restore the
Service, Subscriber shall purchase Top Up Voucher and select the new Service
Plan. If within 30 (thirty) days no Top Up Voucher credited to the Account
or no Service Plan selected, Kejora has right to disconnect the cable to
subscriber's location and customer must return equipment supplied by Kejora.

Suspension or cancellation of a delinquent Subscriber by Kejora will not,
and does not relieve the Subscriber of responsibility for all charges
accrued to the date of suspension or cancellation or for all late charges,
collections fees or similar amounts incurred in connection with the
subscription and may charge interest on all sums outstanding at the rate of
maximum of 3% (three percent) per month.

Kejora Billing cycle is
from month to month and falls due and payable on the 21st day of each and
every moth a subscriber has a service with Kejora
5. Liability
-
When
using the Services which Kejora make available to Subscriber, Subscriber
agrees:
to
abide by all applicable laws, regulations and codes of conduct and to be
solely responsible for all things arising from the use of the Service;
-
not to
infringe any third party rights, including without limitation, the
intellectual property rights of others; give rise to civil liability, or
otherwise violate any local, national, or international law;
-
not to
damage, interfere with or disrupt access to the Service or do anything that
may interrupt or impair its functionality;
-
not to
publish, post, disseminate, distribute or otherwise transmit any defamatory,
offensive, infringing, obscene, indecent or otherwise unlawful or
objectionable material or information through the site or the Service nor
use the Service for any chain letters, junk mail, ´spamming´ material or any
other form of bulk communication or otherwise cause any liability for Kejora
or any other user;

not to
threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of
others, including rights of publicity and privacy; and
-
to abide
by any other acceptable use policy or other terms and conditions which
Kejora may specify from time to time which govern the use of the Service and
as published from time to time on Kejora Website.

Subscriber expressly agrees that the use of the Service and browsing of the
Internet are at Subscriber own risk. Neither Kejora nor any other party
involved in creating, producing or delivering the Service is liable for any
direct, incidental, special, consequential, indirect or punitive damages
arising out of the access to, or use of, or inability to use the Service or
any website or linked site to the Service or for the cost of procurement of
substitute goods or services or resulting from any goods or services
purchased or obtained or messages received or transactions entered into
through the Service or resulting from any unauthorized access to or
alteration of transmissions or data, including but not limited to, damages
for loss of profits, use, data or other intangible property including legal
costs and expenses, even if Kejora has been advised of the possibility of
such damages.
6. Privacy
Kejora will
not disclose Subscriber information to any third party without Subscriber
consent. Kejora may cooperate with legal authorities and/or third parties in the
investigation of any suspected or alleged crime or civil wrong, including
disclosure of Subscriber information, but only if Kejora are required to do so
by law.
7. Indemnity
Subscriber
agrees to indemnify, keep indemnified, defend and hold Kejora and its parent
companies, subsidiaries, affiliates and their respective officers, directors,
employees, owners, agents, information providers and licensors (collectively the
"Indemnified Parties") harmless from and against any and all claims, damages,
liability, losses, costs and expenses (including legal fees) (whether or not
foreseeable or avoidable) incurred or suffered by any Indemnified Party and any
claims or legal proceedings which are brought or threatened
arising from the use of, connection with or conduct on the Service or any breach
by Subscriber of these Terms.
8. General Information
-
These
Terms and all other legal relationships between Kejora and Subscriber shall
be governed by the laws of Republic of Indonesia, and are subject to the
exclusive jurisdiction of the Indonesian Courts.

Kejora
may assign its rights and obligations under these Terms and upon any such
assignment Kejora shall be relieved of any further obligation hereunder.
-
In the
event that any provision of the Terms conflicts with the law under which the
Terms are to be construed or if any such provisions are held invalid by a
court with jurisdiction over the parties to the Terms, such provision will
be deemed to be restated to reflect as nearly as possible the original
intentions of the parties in accordance with applicable law, and the
remainder of these Terms will remain in full force and effect.

Kejora
reserves the right to revise, amend or modify these Terms, other policies
and agreements, and aspects of the Service itself. Notice of any revision,
amendment, or modification will be posted on Kejora Website.
